DUI Laws in California

DUI laws in California have experienced an increased trend towards decreasing blood alcohol concentrations (BAC levels); so much so that now social drinkers are currently finding themselves tangled up in the middle of California DUI laws.

The trend has increasingly targeted social drinkers with relatively low blood alcohol concentrations (BAC levels) and it all begins with the state of California. 

A few years ago the allowable California DUI blood alcohol concentration (BAC) was less than .10%. Over the years special interest lobbyist organizations such as Mothers Against Drunk Driving (MADD) have increasingly pushed within the state of California to lower the allowable blood alcohol levels in an effort to increase the number of drunk driving arrests and consequently DUI convictions.

This effort began in California and has been followed nationwide by legislation that has used California's DUI laws as a model due to the larger population size and high dollar federal highway funding. So by focusing their lobbying efforts on 1 state special interest groups are able to effect change nationwide in a more cost effective manor.

The problem with California DUI laws targeting social drinkers (1st offenders with lower blood alcohol concentrations) is that the statistics point to repeat offenders with high blood alcohol concentrations as the ones causing severe property damage, injury and traffic fatalities in alcohol related incidents. This evidence begs the question;

Are we becoming more vigilant on the 'war against drunk driving' for the right reasons? In other words, are we tightening DUI laws in an effort to save lives or are state governments adjusting their state DUI laws due to the enormous amount of revenue that gets brought in?

The whole point in raising these questions is to begin some dialougue on the subject in an effort to help our nations roadways become safer by more properly allocating our state and federal funding in a more efficient manor by properly identifying the problem and legislating to address that very same problem rather than legislating to provide funding for those who make the most 'noise.'

Again, it all starts with the DUI laws in California as the rest of the states have proven through their previous actions that they use California as a model when reviewing their own state DUI laws.
